Nederland ontploft nu het wetsvoorstel Wet werkelijk rendement box 3 door de Tweede Kamer is aangenomen. Het is het zoveelste voorbeeld van bestuurlijke dwaling. Beleggers met kleinere vermogens, hogere rendementen (overschat uzelf daarbij overigens niet), inflatie en belasting op geld dat al minstens één, maar vaak meerdere keren is belast. Het is bepaald geen fraai geheel. Maar er zijn nog twee punten die laten zien dat de overheid het contact met de werkelijkheid volledig is kwijtgeraakt. Ten eerste: ook al zitten sommige ziedende beleggers er soms duidelijk naast in hun interpretatie van wat de nieuwe wet precies betekent (bijvoorbeeld dat beleggen geen zin meer zou hebben), in hun beleving is dit het laatste zetje om Nederland te verlaten. Dat heeft enorme consequenties voor de maatschappij, het groeivermogen van ons land en uiteindelijk ook voor de overheidsinkomsten. Er verdwijnt niet alleen belastbaar vermogen naar het buitenland, ook het human capital (kennis, vaardigheden, ervaring, talent) van deze mensen vertrekt mee. In een snel vergrijzende samenleving, waarin ook op het dossier immigratie de ene na de andere politieke blunder wordt gemaakt, is dat funest. Van een afstand roepen dat het wel meevalt? Fout. De groep mensen die serieus overweegt te vertrekken groeit exponentieel, geholpen door ervaringsdeskundigen, websites en gespecialiseerde dienstverleners. Bewindslieden moeten dit adresseren. Zoals ik in mijn boek De Grote Herbalancering beschreef, zag Noorwegen een enorm gat in de begroting ontstaan nadat de vermogensbelasting (een veel betere belastingregel, by the way) met slechts 0,25 procentpunt werd verhoogd. Ten tweede: de Nederlandse overheid lijkt geen enkel begrip te hebben van de invloed van haar eigen beleid op de begroting. Zoals onder meer Kapé Breukelaar heeft becijferd (zie grafiek), levert de nieuwe belastingwet de overheid niet méér inkomsten op, maar wél extreme onzekerheid over de omvang daarvan. Soms komt er jarenlang zelfs niets binnen. Onzekerheid is economisch en maatschappelijk extreem destructief. Duizenden boeken van vooraanstaande economen en psychologen laten zien dat onzekerheid groei, in de breedste zin van het woord, remt. Ondernemers nemen minder risico en investeren niet, consumenten stellen bestedingen uit en overheden bouwen steeds grotere begrotingsmarges in. Deze wet breekt het aanpassingsvermogen, de flexibiliteit, en de concurrentiekracht van Nederland. Hoewel de focus van de nieuwe wet logischerwijs ligt op de impact op beleggers, is het misschien nog wel bizarder dat de overheid een wet aanneemt die haar eigen positie op alle mogelijke manieren uitholt. Alleen dat al zou een doorslaggevende reden moeten zijn om deze wet alsnog af te schieten. Maar ja, dan moeten er wel bewindslieden zijn die kunnen rekenen en verbanden leggen met de maatschappij. Soms helpt het daarbij om een studie af te maken. Maar dat is voor een andere keer.

Ja, dat is zeer waarschijnlijk. Er zijn al diverse signalen: • Veel fiscalisten en belangenorganisaties (VNO-NCW, beleggersclubs) noemen het economisch onverstandig en juridisch riskant. • In de Tweede Kamer was er morrende steun, maar forse kritiek op uitvoerbaarheid en de gekozen vorm. • De Raad van State heeft in zijn advies op het wetsvoorstel ook kanttekeningen geplaatst bij de proportionaliteit. • Zodra de eerste aanslagen onder het nieuwe stelsel binnenkomen (2029 over 2028), verwacht ik massale bezwaren, beroep bij de Rechtbank, en doorprocederen naar Hoge Raad en mogelijk prejudiciële vragen aan het EHRM (of rechtstreekse klachten in Straatsburg).

De 2028 box 3 plannen zijn volgens mij behoorlijk in strijd met Europees recht. Door ongerealiseerde (papieren) 'winsten' te belasten moet je effectief assets verkopen om dit op te hoesten. Het Europees Verdrag voor de Rechten van de Mens (EVRM): Protocol 1, artikel 1 – Recht op eigendom Iedere natuurlijke of rechtspersoon heeft recht op het ongestoord genot van zijn eigendom. Niemand mag van zijn eigendom worden beroofd, behalve in het algemeen belang en onder voorwaarden van proportionaliteit. Volgens vaste jurisprudentie van het Europees Hof voor de Rechten van de Mens (EHRM) geldt: Een belasting schendt eigendomsrecht als: - zij geen redelijke verhouding heeft tot het werkelijke draagvermogen - zij leidt tot een buitensporige individuele belasting - zij feitelijk dwingt tot aantasting van het vermogen zelf Uitgangspunt: - Belastingen mogen pijn doen - Maar mogen niet dwingen tot verkoop van eigendom Dat is hier duidelijk wel het geval. Voer voor juristen lijkt me, ik voorzie een lawine van rechtszaken.

MSCI JUST FOOLED EVERYONE WITH THEIR ANNOUNCEMENT 🚨 Today, MSCI announced that it'll not remove Bitcoin and crypto treasury companies from its indexes. This is big news, as it was creating a lot of uncertainty. But MSCI changed one rule, which will impact the treasury companies a lot. As per MSCI, it will not implement increases to number of shares. And this is a huge change. We all know that Strategy and other treasury companies issue new shares to raise money for buying BTC and crypto. Before this rule, big index funds that automatically follow MSCI indexes had to buy some of those new shares, which created a strong demand and allowed companies to issue more shares. But with new rule implementation, this is not going to happen. Index funds won't buy any of the new shares, which means issuing new shares no longer gets that free "passive buying" boost from huge funds. For those who are thinking this is a small deal, Strategy issued $15 billion+ in new shares in 2025. If they try to do something similar in 2026, MSTR will face a brutal crash due to no passive buying. But the real question is this: why did MSCI do this? If you don't know, MSCI was founded by Morgan Stanley and still has deep connections with the bank. Yesterday, Morgan Stanley filed fora spot Bitcoin ETF, and MSTR is a direct competitor. This is because a lot of investors put money in MSTR to gain passive exposure to BTC. Over the years, this has caused MSTR stock to rise, and it has also become the largest corporate holder. With MSCI's new rule, MSTR's ability to acquire more BTC will go down. Any attempt to dilute more shares will crash MSTR due to no passive demand. This will force large investors to pull out their money from MSTR and other treasury companies to put it into ETFs. And a good chunk of that will definitely flow into the Morgan Stanley Bitcoin ETF given it's one of the largest banks in the US. So, MSCI didn't kill the FUD, but rather it killed the purpose of DATs.

Why not? It’s not about the money. Elon doesn’t care about money.
