@JarrydBartle I agree - and it reflects a lack of trust in the judiciary to take them into account sensibly. I predict an increase in psych reports ordered in sentence matters if references are disallowed. More money for report writers but more cost to Legal Aid out of the public purse.

I'm not a Criminologist but a Sociologist I'd make a plea here for Criminolologists to unite now. I think enough evidence over the years has grown for national change. Including arrests for covering up or changing evidence or nit doing your job that leads to public harm..

As near as I can tell, this lengthy piece about a recent sentencing is based exclusively on media reports, rather than reading the actual sentencing remarks. Perhaps the writer was rebuffed when he asked the court for them, but the article should explain that.

All jurisdictions in Australia have statutory protections for counselling communications in sexual offence matters including court approval before release. As an aside, complying with a subpoena is not the same as disclosing to the other party. The court has to approve.

Victim-survivors of family, domestic and sexual violence must feel safe to seek support. Having their private conversations with 1800 RESPECT handed over to their perpetrators, does not provide that safety. It just adds to the trauma they’ve already experienced.

See the issue with flip flopping laws is that it creates inconsistency in prisoners numbers. A focus on building new prisons and being “harsher” diverts funding away from what we actually need. We need justice reinvestment and prevention methods to avoid prison, but once they are imprisoned access to services and education to actively improve lives post-release. This State, actually built a new prison and then committed to bail reform. Didn’t staff that new prison for years which cost billions. Then flipped back to harsher laws and now are scrambling to staff it. All while not actually investing in the staff to run these prisons. We need an increased pay for prison officers, increased training, better staffing and actually empowering them to make meaningful rehabilitation connections whilst in prison. We need to sack private prison operators. It actually takes years to train good prison officers. I’ve spoken to so many officers who have not been given proper training and seen people been absolutely savaged on their first day on the job. Then they just quit. We need to drastically rethink our justice and incarceration system in this state. It’s creating an unsafe society. We just lurch from crisis to crisis and it’s unacceptable. This state deserves so much more.
