Durban Businessman Files Fraud and Defamation Charges Against Mkhwanazi and Dereleen James A Durban businessman heavily implicated in the ongoing Madlanga Commission of Inquiry has opened criminal cases of fraud and crimen injuria (defamation) against ActionSA MP Dereleen James and KwaZulu-Natal Police Commissioner Lieutenant-General Nhlanhla Stuart James Scharnick filed the charges in Tshwane on Thursday. He claims the parliamentarian and top KZN cop used factually incorrect information about him during proceedings of Parliament’s Ad Hoc Committee on police matters, damaging his reputation. Scharnick has repeatedly denied being a “hijacking kingpin” and insists his criminal record was tampered with. KZN police have publicly linked him to nearly 30 criminal cases in the province alone, including vehicle hijackings and theft, some of which resulted in convictions. He has also been tied to suspended Deputy National Police Commissioner Shadrack Sibiya during explosive testimony at the commission. The Madlanga Commission, chaired by retired Constitutional Court Justice Mbuyiseli Madlanga, is investigating widespread allegations of criminality, political interference and corruption across the South African Police Service and criminal justice system. It was established last year following public allegations by Mkhwanazi himself. This latest counter-move by Scharnick marks another flashpoint in the high-stakes public battle playing out at the commission and in Parliament, where implicated figures are increasingly pushing back against police and political testimony. No immediate comment was available from James or Mkhwanazi.
