Why does @FINRA even exist? @SECPaulSAtkins "A trade took place so it needs to be reported" (paraphrasing) is not a valid justification for creating a market for a Series A Preferred placeholder with inaccurate information. To say that those that made MMTLP tradeable relied on publicly available information so it's ok, is not how it works. When an issuer notifies a regulator to tell them that their security isn't supposed to be trading and that the information used is inaccurate, this puts the regulator on notice that the situation needs to be investigated. Why? Because you can't claim your existence is based on investor protection and Market integrity if you fail at both!
