Yeah, this is what people don’t get. Provocation, as the law sees it, is not the same as we do. Any sort of provocation that would invalidate your claim to self-defense would be illegal—and if Chud was engaged in such activity by merely using insulting words, then he would have been arrested long prior.

I'm sorry but has nothing to do with race or free speech. You can't provoke an unarmed person with the intent of shooting him if he poses a non lethal threat.
Joe Prich@JustCallMeJoeP

Regartless what you think of Bud the Chuilder this discussion needed to be had anyway. This whole "I can attack you with impunity because you made a specific sound with your mouth" thing has to come to an end. It's incongruous to a civilized and free society

Guys… the 1st Amendment only protects you from the government silencing or persecuting you for your speech. If you go out and harass people for clicks, you open yourself to a host of consequences that have nothing to do with the 1A nor the government. Doing so also throws self defense out the window, as you initiated the engagement. This is common sense. If this makes you angry, you are probably stupid.

@MoffFrieren @CBHeresy @cocaine_james00 Sure, the person who got shot should be charged with assault. That isnt relevant to a self defense claim though. You need to prove YOUR use of force was lawful, and that typically precludes you provoking the assault. The exception in TN is when you attempt to flee.

Good luck explaining a self defense shooting when you walk around calling black people “n*ggers” for clicks.

Best I can tell, this Chud thing has zero to do with the First Amendment. He isn’t being censored by the government or charged with speech related crimes; he’s being charged for a use of lethal force incident. This is going to be a test of TN’s self defense laws.
I Am Leah@Bossy_Leah

You don’t have to like Chud the Builder to believe that freedom of speech is an absolute right of all Americans. No words are off limits in a free country and assaulting someone over a word is third world, low IQ, low emotional intelligence behavior. Type it out. Say it loud. Carry everywhere.

@stillnotking75 @memeticsisyphus You can be prosecuted for speech, on the basis that your speech was "fighting words" and thus not protected by 1A, but it requires a seperate charge like disturbing the peace.

@memeticsisyphus "Fighting words" does not give anyone license to commit assault, nor does it have anything to do with self-defense. It's just a category of non-protected speech, i.e. one can be prosecuted for attempting to incite violence by personal insult

The general public’s conception of “fighting words” is about as accurate as Michael Scott saying he was a victim of a hate crime because he hated it.

@ToeRogansbloat @cocaine_james00 @CBHeresy Use of deadly force in self defense is typically allowed when you are reasonably in fear of serious bodily injury. However, provoking the encounter usually precludes a self defense claim absent very specific circumstances.

@MoffFrieren @CBHeresy @cocaine_james00 This isn't going to go before the Supreme Court, and the fighting words doctrine isn't relevant here. The other man can invoke the fighting words doctrine if he is charged, but the shooter must prove by a preponderance of the evidence that he had a right to self defense here.

@Kosisochukwu919 @elonmusk @SawyerMerritt @Starlink If the service is directly offered by Starlink on the flight, there is no liability for Delta as they are not the ISP in that case. If anything, monitoring traffic on the network only increases liability, as you lose § 512 safe harbor protections when you have actual knowledge.

Delta knows their passengers better than Elon does. Forcing ‘seamless’ Starlink means no way to upsell, filter porn, or track usage for safety/liability. Airlines aren’t your living room this is corporate ego, not customer service.” Short, triggers the Musk stans, and flips the script on “effortless = better.

Delta rejected adopting SpaceX's @Starlink on its fleet because it wanted to provide internet connectivity to passengers via the Delta Sync portal, instead of the Starlink-branded portal. Delta has since chosen to partner with Amazon's LEO. This will result in Delta falling behind many of its competitors in offering high-speed WiFi onboard, as many other carriers are already offering or installing Starlink, whereas Amazon's LEO airplane WiFi for Delta is still a couple year away (or more). Satellites currently in orbit: • SpaceX's Starlink: 10,400 • Amazon's LEO: 300 (Delta rejection info according to Ron Baron)

@BlakeWhittle7 Cloudways uses DigitalOcean (among others) with a 2X markup for their management panel and support, how is that cheaper?

Blake Whittle - Attending #WCEU
New client call today, and he wanted to keep his WP site on DigitalOcean. I told him that we'd like to move it to Cloudways for easier, cheaper, and more efficient management. He still hesitated, and said that he's been managing things fine for years without server access and never had to do the things I said we need to do (like PHP upgrades!) I did a quick check on the call, he's still running PHP 7.4. Changed his tune a little bit. We're still proceeding, but carving out any responsibility for management or maintenance on the site. If the site crashes, not my problem. If it gets hacked, not my problem.

@RealPostFolder The issue is that if you are under 24, any financial aid awards are calculated by including your parents income. Federal student loans are also capped at a much lower rate. The expectation of the federal government is that you will support your child through college.

'Spreading his wings' philosophy is bullshit. This is something lazy parents do to get rid of their kids. Parents should get that children are a lifelong commitment and investment, not something to be disregarded after 18 years. When I was a teenager, I had a friend whose parents did this to him after college freshman year. Communication and all financial aid were cut off, saying that "it was for his own good." 2 years later, the most hardworking and brilliant person I knew, is working as a delivery guy just to make ends meet. He lived in a crappy basement in an old house belonging to a hag in the worst part of the town. This was a guy who topped in his class and voted most likely to become successful. If you want your son to have a good life, help him
