UPDATE: The plunder case filed against Sen. Rodante Marcoleta, former Quezon City Rep. Mike Defensor, and businessmen Aristotle Viray and Joseph Espiritu has been raffled to the Sandiganbayan 3rd Division, chaired by Associate Justice Karl Miranda.
The charges against Marcoleta and Defensor for violation of Presidential Decree No. 46, which prohibits public officials from receiving gifts and private individuals from giving them, were assigned to the 4th Division, headed by Associate Justice Michael Musngi.
The same PD 46 cases against businessman Joseph Espiritu and Aristotle Viray were separately raffled to the 6th Division, chaired by Associate Justice Sarah Fernandez, and the 1st Division, headed by Associate Justice Maria Mendoza-Arcega, respectively. | via Jown Manalo, bnc.ph

ATTY. OLIVA QUESTIONS PLUNDER CHARGE IN MARCOLETA, DEFENSOR CASE
Legal social media content creator Atty. Regal Oliva questioned the plunder complaint filed against Senator Rodante Marcoleta and former Anakalusugan Party-list Representative Mike Defensor, arguing that the allegations involve private funds rather than public money.
Speaking on #TheSpokes, Oliva said campaign donations are private contributions intended for election-related expenses and should be reported in the Statement of Contributions and Expenditures (SOCE), not in a Statement of Assets, Liabilities, and Net Worth (SALN).
According to Oliva, the issue may be addressed through corrections to the SOCE, but he does not see how the alleged circumstances would support a plunder charge.
