META LAWSUIT GIVES US IN-DEPTH LOOK AT THEIR LAYOFFS A federal judge ordered Meta to explain under oath how 4 visa holders landed on the May layoff list. Meta's HR director answered Wednesday in a 13-page sworn declaration. No outlet has reported it yet. What is inside: 1. Meta has 7 performance ratings. Under oath: "Consistently Met Expectations" is "the lowest rating that does not fall below expectations." The plaintiff who had it was cut anyway. 2. A "Met Most Expectations" rating "indicates that the employee's performance did not meet the expectations for their role and level." At Meta, meeting most expectations is below expectations. 3. Org chart depth was a layoff criterion. Sworn example: employees six levels below Mark Zuckerberg could be marked for elimination. Managers with fewer than 7 direct reports could be cut when the average team ran 10. 4. One plaintiff was terminated less than 2 weeks after returning from maternity leave. Meta's defense: "nearly 40% of Doe 26's team was selected for termination, demonstrating that Doe 26 was not singled out." 5. "AI was not used to conduct the RIF. AI did not select anyone for termination." Meta also swears its activity monitoring tool launched April 22, when selection was "already well underway." Termination notices went out May 20. 6. The judge demanded this filing because the 4 face a 60-day window to find a new sponsor or leave the country. The 13 pages never mention that clock or what happens when it runs out. 7. Meta says the criteria used on every laid-off employee are reflected in their OWBPA disclosure paperwork. If you were cut, you may be holding the receipt. The word Meta chose, under penalty of perjury, for the plaintiffs' leave histories: "coincidental."
