Today marks the successful conclusion of an employment dispute through structured conciliation and lawful process. Following proceedings before the Office of the Labour Commissioner, Pune, the matter has been amicably resolved and the employee has received his Full and Final settlement. The resolution was achieved through institutional mechanisms provided under labour law, without prolonged litigation and without unnecessary escalation. We place on record our sincere appreciation for Mrs. Kasturi Mahatme, Government Labour Officer, whose balanced and principled approach during conciliation ensured that the process remained constructive, fair and resolution focused. Today, NITES has formally submitted a complaint to the Union Labour Minister against Wipro Limited over a deeply disturbing recruitment issue affecting India’s youth. More than 250 fresh graduates across multiple states were selected through campus hiring. They received Letters of Intent. Many even received confirmed onboarding emails with joining dates and locations. They completed all formalities, including background verification, which was marked as fully cleared in the company’s own systems. And then they were left waiting. For six to eight months. No joining. No rejection. No written explanation. During this time, these young professionals trusted the word of a reputed IT company. They declined other job offers. Many were blocked by campus placement rules. Families that invested everything in education believed their children’s futures were secure. Today, those same candidates are unemployed, financially stressed, and mentally exhausted. What makes this even more troubling is that while these selected candidates remain in limbo, onboarding of others has continued. There has been no transparency, no objective criteria, and no accountability. Repeated follow ups were met with silence or automated replies citing vague business requirements. This is not a normal hiring delay. Keeping selected candidates waiting indefinitely after issuing Letters of Intent and confirmed onboarding communications is not just unethical. It raises serious questions about fairness, recruitment responsibility, and respect for young careers. At a time when the country speaks about skilling, employability, and demographic dividend, practices like these push fresh graduates into uncertainty and despair. These candidates are not asking for favours. They are asking for certainty. They are asking for dignity. They are asking for fairness. Pune's economic strength rests on its MIDC zones, IT parks, and industrial corridors such as Hinjewadi, Talawade, and Chakan, which collectively generate employment for lakhs of people. Despite this, the city still lacks a focused and integrated transport policy for these employment hubs. Weak public transport connectivity, inadequate last-mile solutions, and poor coordination between metro, buses, and feeder services continue to push employees towards private vehicles, resulting in congestion, pollution, time loss, and reduced quality of life. Public transport is not merely an infrastructure issue. It is a question of dignity, safety, productivity, and environmental responsibility. Shift workers, especially women employees, require safe, reliable, and affordable transport options during early morning and late-night hours. Office-time special services, metro-bus integration, corporate-supported feeder routes, carpooling incentives, and green mobility solutions can significantly ease daily commuting stress if implemented with intent. As cities aspire to become “smart,” mobility must be citizen-centric rather than vehicle-centric. Investment in public transport should be seen not as an expense, but as a long-term economic, social, and environmental return. A dedicated transport strategy for industrial and IT zones is no longer optional; it is essential for sustainable urban growth. A recent judgment of the Delhi High Court carries important lessons for the IT sector. In King Airways vs Captain Pritam Singh, the Delhi High Court held that airline pilots qualify as workmen under Section 2(s) of the Industrial Disputes Act, 1947, even though they draw high salaries and hold senior designations such as Captain or Pilot-in-Command. The case arose when King Airways withheld salary and other dues of its pilots. When the pilots approached the Labour Court for recovery of unpaid wages, the airline contested their claims by arguing that they were not “workmen” due to their high salaries and senior positions. The Delhi High Court rejected this defence and upheld that pilots are workmen under the Industrial Disputes Act. The Court reaffirmed a settled principle of labour law. Salary and designation are not decisive. What matters is the predominant nature of duties actually performed. The Court found that a pilot’s primary role is technical and operational, namely flying the aircraft. Any direction or control over crew members is incidental to flight safety and does not amount to managerial or supervisory control in the industrial sense. High remuneration by itself was held to be legally irrelevant unless the employee is first shown to be performing supervisory or managerial functions. This reasoning has direct relevance for IT employees. In the IT sector, many employees hold designations such as Senior Software Engineer, Lead Consultant, Technical Lead or Architect, yet their day to day work remains largely technical. They write code, debug systems, manage deployments, handle tickets and deliver individual technical output. In substance, their role is skilled and operational, not managerial. Due to lack of legal awareness, many IT employees do not challenge illegal termination, forced resignations, unpaid dues or unfair labour practices. A widespread myth exists in the IT sector that labour laws do not apply to employees drawing high salaries or holding fancy designations. This judgment clearly demonstrates that such assumptions have no legal basis. The Industrial Disputes Act is a beneficial legislation meant to protect employees from arbitrary and illegal actions by employers. If an IT employee qualifies as a workman, remedies such as reinstatement, back wages or compensation can be pursued before Labour Courts and Industrial Tribunals, often offering more effective relief than ordinary civil litigation. Courts have consistently held that employment rights cannot be defeated by labels, compensation structures or contractual drafting. NITES has submitted a formal complaint to the Labour Ministry, Government of Maharashtra, regarding the non-compliance by Infosys with the Government Resolution dated 28 November 2025 relating to mandatory paid leave for employees to cast their vote on 2 December 2025. The GR clearly directs all establishments, including the IT and ITES sector, to provide full paid leave or at least one to three hours of paid time off to every registered voter in the affected constituencies. However, the internal communication issued by Infosys only refers to a “time out to vote” without any assurance that such time will be fully paid. It further places the burden on employees to seek managerial approval, a condition not contemplated under the GR and one that could restrict or discourage employees from exercising their democratic right. Such ambiguity creates unnecessary anxiety among employees about possible salary deductions, leave adjustments, or denial of time off. Voting is not only a constitutional duty but also an essential pillar of participatory governance, and employers are obligated to facilitate this process in accordance with the law. NITES has requested the Labour Commissioner Pune to initiate an immediate inquiry and direct Infosys to issue a clear and legally compliant communication safeguarding employees’ right to paid voting leave. We have also urged the authorities to ensure strict implementation of the GR across the IT and ITES sector in Pune so that every employee can participate in the electoral process without fear or hesitation.
