So why is Trump attending the SCOTUS hearing on birthright citizenship? It’s not like he’s going to understand any of the words being said.

@ArmedAndGentle @SleestakMack If an undocumented person commits a crime, they are arrested and tried in a U.S. court. If they weren't under U.S. jurisdiction, the government would have no legal authority to prosecute them or even deport them for that matter.

@Nebraskawriter2 @SleestakMack No, not the illegal ones. They are NOT under US jurisdiction. The government doesn't even know they are here. Habeas corpus and judicial due process does not apply to them because judicial system doesn't know who they are. Deportation is the only process available to them.

If a foreign diplomat gives birth in New York, the child is not a US citizen. But if the diplomat illegally sneaks into the country and THEN gives birth, bingo! US citizenship! That’s how dumb our current interpretation of the 14th Amendment is.

@james_xond Yeah but not in a negative way, not for me, at least. There is a certain peacefulness in knowing that you don't have decades left to navigate. My kids are grown. They have kids of their own. They are in good places, so...

@NormOrnstein Unless the Court has gotten rid of the designated chair referenced in this 1986 National Park Service nomination to the Registry of Historic Places, then yes, there is a designated chair.

Cultist gonna lie. The Supreme Court's courtroom is designed for the Justices, attorneys, and select guests, with no special seating arrangements for the President during oral arguments. While the President can attend as a guest, there is no designated chair for them. Notably, there is no official record of any sitting President attending oral arguments.
AAGHarmeetDhillon@AAGDhillon

There’s literally a chair set up at SCOTUS for our presidents to sit in for oral argument. Your separation of powers nonsense is more imitation pearl-clutching hauteur.

@SleestakMack The problem with that is you are making assumptions about what the authors of the amendment meant as opposed to interpreting the verbiage as written. Subject to the jurisdiction thereof, the laws of the country, not the politics or allegiance of it. SCOTUS will decide I guess.

@Nebraskawriter2 There is no question that illegal aliens are subject to in personum jurisdiction, no one disputes that. The question is whether they are subject to “full” or “political” jurisdiction in the old common law sense, which is likely what the amendment is referencing.

@SleestakMack I don't know if I agree that they should have citizenship but the constitution does say they do. If Trump wants to change that, he needs to change the Constitution, not try to usurp the authority of the legislative branch.

@johnpetrey @davec_NH There is a multi-layered system of tracking and verifying mail-in votes. Most states use Intelligent Mail barcodes, which allow both the election office and the voter to track the ballot’s progress through the USPS system, much like a commercial package.

@davec_NH With mail-in voting there is no auditable chain of custody & thus no ability to detect fraud. You can never know who got the ballot, who completed the ballot, was person coerced or did they sell the ballot, etc. No fraud detection = no fraud measurement = no election integrity.

The Trump EO on mail in ballots may be BRILLIANT - States run elections per the Constitution. Don't fight them on that ....... BUT - the mail system is Federal, you want to use that - follow our rules.

@davec_NH @RobertLutherFL First of all, he can't use federal funds in a punitive manner. That's already be adjudicated in court. Second, the Constitution is pretty clear. The language isn't vague in any way. The Executive branch has no control over the election process. This is DOA in the court system.

@RobertLutherFL So does that apply to the restrictions on shipment of handguns to "FFL only" by the USPS ?

The faster we get this over the better. If we seize Kharg Island, it's technically boots on the ground. It could be done almost flawlessly. If we have enough firepower, it would be very easy to defend."

SCOOP: Trump will sign an executive order at 5pm, cracking down on mail-in voting across the country, @DailyCaller has learned. The executive order will require the admin to create a list of confirmed U.S. citizens who are eligible to vote in each state. It will also mandate that absentee ballots only be sent to those on each state's approved mail-in ballot list. Ballots will now have specific secure envelopes, with unique barcodes for tracking. States who disobey the order may lose federal funds under the presidential action.

@reaganreese_ @DailyCaller Never survive a court challenge. He has already tried this in several forms and it got knocked out each time. The courts also knocked down previous attempts to use federal funds as a punitive tool. He is finally getting the SAVE Act isn't going to pass, though.
