That is the Fan Content Policy, which is in regards content created by the fans. Quoting paragraph 2, "In this Policy, “Fan Content” means: your personal, non-commercial (i) fan art (such as artwork, photographs, videos, and other materials) that is based on the Epic IP; and (ii) Epic IP-related websites and apps that are freely accessible to the public." The term fan content does NOT apply to assets created by Epic themselves. The term fan content DOES apply to assets inspired by the work of Epic Games, but not made by individuals affiliated with the company. You cannot claim that ripping and redistributing assets such as, say, dozens of resources made for the Chapter 2 Remix Finale event, is fan content. It is Epic's IP, which does not apply to the fan content rules. If you'll take a look at the Fortnite Developer Rules, which discusses usage of Epic's intellectual property, you'll see in Section 1.7.1 that "Epic owns intellectual property (IP) rights in all of its original creations. You may use Epic-owned assets made available to you in UEFN in your island, including in your in-island items for sale. However, you may not use recreated or otherwise obtained assets, maps, characters, music etc., from Fortnite or other Epic-owned properties without permission, either in your island or its metadata. This states that, if Epic owns the rights to everything they create, which does apply to most of the resources hosted on your site! Now, if you look towards the Intellectual Property Law of the United States of America, you'll find this statement under Copyright Law: "Holders of copyrights generally have the exclusive right to reproduce the work, publicly perform and display it, distribute it, and prepare derivative works from it. For most works created today, the copyright does not expire until 70 years after the death of the author. Once the copyright is registered, copyright holders may sue infringers in court to seek injunctions and damages." This means that only Epic have the rights to use or redistribute these assets. If you wish to do so, you must obtain explicit legal permission from the company. congress.gov/crs-product/IF… You do not have the legal rights to have these assets, let alone to redistribute them.
