I understand why many do not want to leave the Judicial Committee of the Privy Council, they do not trust the local system. They do not believe that local/Caribbean judges are truly independent of the executive branch of government; they believe judges are subservient in many ways to politicians, and susceptible to special interests. They don’t trust the system to be fair right through, and to take responsibility when agents in the system muck up and to implement remedies for wrongs on a timely basis or at all. Staying with the Privy Council does not address the fears in a global way as very few appellants access the Privy Council annually for variety of reasons, cost being primary. No amount of data, no amount logical argumentation will override this trust deficit. It seems to me the message is: bring the local system up to par, rid the system of class, color and status biases, build trust in the population and then ask whether we should leave.
