Bad becomes worse? Further changes proposed to the proposed changes to IT Rules! Today, post-noon on 21 April 2026, the Ministry of Electronics and Information Technology (MeitY) has published further proposed amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Second Amendment Rules, 2026. The notice states that these are limited to Rule 3(3)(a)(ii) requiring that labels identifying synthetically generated information be continuously and clearly visible throughout the duration of the content in visual display. This goes beyond the earlier requirement of “prominent” visibility, and now mandates persistent, uninterrupted disclosure for the entire duration of such content. This requirement is applicable to all users of social media and AI tools, and not just digital news platforms. All other provisions in the newly updated draft remain the same as the draft circulated on 30 March 2026. Our comments to the MeitY are available here. The consultation timeline has now been extended allowing stakeholders to submit comments on both the earlier draft amendments and these additional amendments by 07 May 2026. We note that suggesting changes within the window of a pre-existing public consultation process in which thousands of Indians have voiced opposition is likely to result in, “consultation fatigue” and at the very least demonstrates a pattern of ad-hoc policy making than one which accounts for structured and planned feedback. Further, MeitY has once again indicated that the submissions will be held in fiduciary capacity in MeitY and shall not be disclosed to any one at any stage, enabling persons to submit feedback/comments freely without any hesitation. Importantly, consultation processes are important for democratic decision making, placing the responses in the public domain would ensure meaningful engagement and participation by stakeholders. It would also allow for better analysis, understanding, and fair critique of the various perspectives put forward. We therefore urge MeitY to place the comments and feedback on their website in the interest of democracy and transparency. We urge citizenry to participate in such public consultation and share their feedback/comments on the draft rules in a rule wise manner by email to itrules.consultation@meity.gov.in in MS Word or PDF format by 07th May, 2026. We have drafted a short template email which readers can improvise upon. As of today, more than 4500 people have used our link to improve upon and send their own comments to MeitY primarily asking for a withdrawal of the proposed changes to the IT Rules, 2021.
