I’m not for or against Andrew, but he’s leaving out the crux of the accusation which is not that he publicly stated he’s getting long, but that, after those alleged pumps, he dumped (or covered) without similar disclosure.
I cant help but pointing out that failing to disclose the crux of the accusation rhymes with the actual thing they’re charging him with.
All that said, is it a crime? Should it be a crime?
I agree with Andrew: it should generally not be unless it’s clear cut fraud. Hard to see this as fully hittng the fraud threshold, unless you squint and try hard to establish both reliance and intent. But that seems like a stretch.

At a hearing last month, a government lawyer told the court that the defense—meaning me—“wishes this were a false statements case, but it’s not.”
The purported misconduct isn’t falsity. It’s effectiveness. People listened. Prices moved. I traded. According to the Justice Department, that’s “market manipulation.” One can, apparently, create an artificial market by telling the truth."
