I spent an embarrassing amount of time this morning reading their dockets. - they had third party releases and exculpation that contributed to the estate and ended up being contested after confirmation by the trustee and the SEC for not allowing class 8 (shareholders) to vote - they used an 1145 exemption to issue new equity in the private company, of which 64% went to DIP funders - they utilized the NOLs and had procedures for large shareholders to report any changes in ownership to preserve maximum NOL value - Leonard Green of Joann fame (lol) was one - Houlihan Lokey worked on the financing - the list of creditors was redacted and sealed I didn’t hold this into cancellation, but due to their prior agreement with BBBYQ to honor the gift cards, I got curious. 😂
