The din of the proposed changes in the Land Grants Act refuses to die down. This is the recurring gossip amongst the elites. I personally feel that misrepresentation and selling something as “for the poor” when the poor are not even remotely connected to the proposed changes is a sin. First we fail to do anything for the poor and second we use the name of the poor to provide cover to the process of exploitatively enriching the elites. I have a humble submission. This bombast that the bill is for the poor is very very irritating. Could you please tell us how the poor will be helped in the proposed changes in the Land Grants Act. Can you identify the poor people. There are 51 lakh souls in J and K officially recognised as poor(BPL AND AAY). How would these changes help them. Next comes the lower middle income group, slightly above the BPL. How does it help them. It is not meant to help them and will not help them. On the other end of the spectrum are the super elites the super rich of Jammu and Kashmir. I know for sure that any amendments are meant to help them. That’s the sole motive of the government. And I am not against help being rendered to them. But why use the name of the poor. And why leave out the poor. The government of the day has two set of supporters. One is those who didn’t queue up on the polling day but donated money for the ruling party. And second are those lakhs of poor souls who queued up for hours and voted for the ruling party. This bill if it is tabled and passed will be for the elite donors who paid donations and not the poor voters. So a government elected by the voters for the rich, elite donors. But then those queued up elected a government which it seems we as people deserved. Garbage in Garbage out.

In the context of the JKAS results. Only one person has been selected from the Kashmir division under the EWS category. Two most important indicators of EWS, are souls living below poverty line, officially identified under two categories viz. (Antyodaya Anna Yojana (AAY) + Priority Households (PHH). These are however not used to determine EWS status for recruitment or admissions. The number of souls in the Below Poverty Line Category (Antyodaya Anna Yojana (AAY) + Priority Households (PHH)) in Kashmir Valley exceeds that in Jammu. As per official data of J&K Government, 37.71 lakh such population is in Kashmir and 29.81 lakh in Jammu. AAY are the poorest of the poor while PHH covers families which were earlier called BPL. The government, in response to my questions in the second and fourth sessions of the Assembly respectively, revealed that only 7.7% and 8.6% of certificates issued under EWS category were from Kashmir. Both sets of data are from official sources. So when you define poverty(EWS) for the department of food supplies, government has a different definition. And when you define poverty(EWS) for recruitment and admissions, government has a different definition. Of the nine candidates selected under the Economically Weaker Section Category (EWS) in the recent Combined Entrance Examination combined to recruitment for recruitment to JKAS and other services only ONE is from Kashmir. And it is not surprising. Incidentally the predictions made in the presentation that I had prepared on reservations almost overlap. We had predicted 2/10 and result is 1/9. The problem lies in the criteria for granting these certificates. While almost all BPL population in Kashmir falls within the income criteria for issuing these certificates, the asset-related conditions, especially the size of the residential house and residential plot ensures exclusion of Kashmiris from the EWS category. Why cannot the government remove asset-related criteria? It can be done and has been done by several states. An expert set-up by the Government of India on December 01, 2021 favoured the removal of exclusion based on family residential assets. It is grave injustice with people of Kashmir. We have 5. 09 lakh BPL souls in Srinagar, 5. 21 lakh in Kupwara 5. 79 lakh in Baramulla and 5. 76 lakh in Anantnag. The EWS certificates could have been a major confidence building measure for old city Srinagar, old town Baramulla, Anantnag , Budgam parts of Sopore etc awhose inhabitants have been left out of the developmental process for decades. It is time to study what states like Rajasthan and Kerala have done. If they have done away with asset-related conditions, why cannot we. I request the CM sahib to look into the matter. This is not something which should be delayed. There is no excuse for delay. Every recruitment process without corrections means injustice. This correction is overdue. All the reservations are heavily tilted towards Jammu. This particular category is tilted towards Jammu because of government norms, not because Kashmir is rich and Jammu is poor

If there is any bill which is apparently going to be supported by the government, seeking amendments to land grants , it will be injustice if it is focused solely on the rich and elite. We support relief for all. The most important is the legal rights of those:- Who are landless, and have made their homes on government land. These are small land holdings. They are the most vulnerable and attract frequent visits from government officials. Those who have been allowed shops and small commercial establishments from SDA, JDA, SMC, JMC, Urban Bodies and other government and semi government entities. In most of the cases they have paid market premium, which is almost equal or more than the market price. Yet there is a creeping ambiguity in their ownership. They are not allowed to sub lease or sell. And many have been sent eviction notices. An eviction notice today is a post dated cheque for physical eviction at a future date. Those who have paid market prices in buying residential property in the form of land or flats from Government entities. And despite paying market prices they do not have proprietary rights. And face same problems in selling and sub leasing. The changes post 2019 are not confined to hotels. There have been massive changes in the urban development department. And an ambiguity in ownership has been created by change in rules. These rules will form the basis of unlawful and illegal eviction in the event of a hostile government in future. Government cannot be run for the benefit of top elite. We support amendments. But amendments should first be for the poorest of the poor, then the poor, then the middle class and lastly the elite.

The developments in Iran and the Gulf region are distressing to say the least. And extremely sad and brutal is the killing of Iran’s Supreme Leader, Ayatollah Sayyid Ali Hosseini Khamenei. I pray for peace in Iran and the Gulf region. May peace prevail. And May Allah grant patience to those who are in a state of mourning. These are extremely disturbing times with families worried about their loved ones stuck in countries overtaken by conflict. Hope they all return their home unharmed

While I may have many political differences with @DrVeeri, this is not about politics—it is about a genuine public issue. Right now, a growing sense of arrogance is visible within the @JKNC_, which is deeply concerning. Even CM @OmarAbdullah seems unable to tolerate questions from within his own party. @DrVeeri raised a valid concern about the rising electricity bill rates, an issue affecting common people. Instead of addressing it properly, the response was diverted, and he was subjected to criticism. This kind of approach weakens democratic values. When even internal voices are not respected, it raises serious questions about accountability and governance...

Is the government aware of this move on reservations per a news report in the Daily Excelsior? Have they been informed? I had in my humble capacity raised the same issue in the assembly. I had contended that there is no evidence of research and that recommendations should have been backed by research. I will hopefully raise this issue in the appropriate forum.
