Wife's Gender Alone Doesn't Justify Maintenance: Karnataka High Court Sets Aside ₹20,000 Interim Maintenance In a significant judgment reinforcing that maintenance laws are meant to address financial dependency rather than gender alone, the Karnataka High Court has held that a wife's status as a woman cannot, by itself, justify an award of maintenance. Facts of the Case The wife had sought interim maintenance of over ₹1.13 lakh per month under the Protection of Women from Domestic Violence Act, 2005. The Trial Court directed the husband to pay ₹20,000 per month as interim maintenance. The husband challenged the order before the High Court. The Court examined the financial disclosures of both parties and found: - The husband was earning approximately ₹60,000 per month. - The wife admitted earning ₹1 lakh per month, while the TDS records reflected a monthly salary of around ₹1.64 lakh. - The couple had no children, and there was no material placed before the Court to substantiate the wife's claim of outstanding marriage-related debts or other financial liabilities. The High Court observed that the Trial Court had considered only the husband's income while completely ignoring the wife's financial capacity, making the interim maintenance order unsustainable. The Court made an important observation: Merely because a wife invokes the provisions relating to maintenance, courts cannot automatically direct the husband to pay maintenance. Where the wife is financially independent, earns more than the husband, and has no substantial liabilities, maintenance cannot be awarded solely on the assumption that every wife must be maintained by her husband. Court reinforced important legal principle: - Maintenance is based on economic need and comparative financial capacity- not gender stereotypes. - Every maintenance claim must be decided on its own facts after considering: - The income of both spouses; - Their financial obligations; - Standard of living; - Dependents; and - Genuine inability to maintain oneself.
