Abstimmungen werden im Parlament erzwungen. Geschäftsordnungswidrig. So lange abgestimmt bis Ergebnis passt. Man kann der CDU nichts mehr glauben. Manfred Weber (EPP/CSU) war der zentrale Antreiber hinter Wiederbelebung der #Chatkontrolle. Was in Brüssel passiert ist kriminell.

EU can pressure these same social media companies to use their existing scanning tools to target political opponents, journalists, marginalized groups under the guise of security.

Die Chatkontrolle ist beschlossen, trotz Mehrheit dagegen! 314 Abgeordnete stimmten gegen die Chatkontrolle, nur 276 dafür. Trotzdem geht sie durch. Warum? Weil durch einen umstrittenen Verfahrenstrick 360 Nein-Stimmen nötig gewesen wären, um den Dringlichkeitsantrag zu stoppen. So wird ein Gesetz wiederbelebt, das das Europäische Parlament bereits mehrfach abgelehnt hatte. Die Chatkontrolle 1.0 ist ein Gesetzes-Zombie. Es wird so lange abgestimmt, bis das gewünschte Ergebnis herauskommt. Das schwächt das Vertrauen in die Demokratie. Die Chatkontrolle ist ein Trojanisches Pferd für die anlasslose Massenüberwachung von hunderten Millionen EU-Bürgern. Tech-Konzerne sollen private Kommunikation ohne konkreten Verdacht scannen, obwohl diese Maßnahme keinen wirksamen Beitrag zur gezielten Bekämpfung von Kindesmissbrauch leistet. Die befristete Ausnahmeregelung zur E-Privacy-Richtlinie war ausgelaufen. Das Europäische Parlament hatte sie nicht verlängert. Nun wurde versucht, diese Entscheidung durch erneute Abstimmungen und massiven Druck auf Abgeordnete auszuhebeln. Dabei ist die Chatkontrolle nachweislich nicht erforderlich. Auch nach Auslaufen der Regelung erhielt die Polizei weiterhin zahlreiche Hinweise auf Kindesmissbrauch. Einige Tech-Konzerne scannen ohnehin auf anderer Rechtsgrundlage weiter. Das eigentliche Problem ist nicht der Mangel an Daten, sondern fehlende Kapazitäten für eine effektive Strafverfolgung. Zudem finden viele Straftaten im Darknet oder im analogen Raum statt. Niemand würde akzeptieren, dass der Staat jeden Brief öffnet, um Straftäter zu finden. Warum sollte das bei privaten Chats anders sein? Schon heute können Ermittlungsbehörden bei konkretem Verdacht und mit richterlicher Anordnung auf private Kommunikation zugreifen. Dafür braucht es keine anlasslose Massenüberwachung. Der Schutz von Kindern ist unverzichtbar. Aber dieses berechtigte Anliegen darf nicht als Vorwand dienen, um immer weiter in die Privatsphäre aller Bürger einzugreifen. Es drängt sich der Verdacht auf, dass unter diesem Banner eine Internet-Stasi 2.0 geschaffen werden soll. Wir lehnen das anlasslose Ausschnüffeln von hunderten Millionen Bürgern ab und werden bis zur letzten Sekunde dagegen Widerstand leisten. Gegen die Durchsetzung der Chatkontrolle im Eilverfahren wird es ganz sicher Klagen hageln.

Veranstaltungstipp: Wer heute in Tübingen noch nichts vorhat - mein wunderbarer Kollege Volker Rekittke liest aus seinem neuen Buch über den Journalismus als Brandbeschleuniger der Corona-Jahre, um 19 Uhr in der Begegnungsstätte Hirsch. Leider bin ich nicht vor Ort, sonst würde ich hingehen, und auf das Buch bin ich sehr gespannt.

Die Chatkontrolle kommt. Kein guter Tag für Freiheit & Bürgerrechte…

Der Dringlichkeitsantrag zur Chat-Kontrolle („abstimmen bis Ergebnis passt“) ist mit extrem knapper Mehrheit durch. Die inhaltliche Abstimmung über die Chat-Kontrolle 1.0 (freiwilliges anlassloses Scannen von Chats durch die Tech-Konzerne) erfolgt am Donnerstag. Aber: Selbst wenn eine Mehrheit für eine erneute Chat-Kontrolle 1.0 stimmt, die Rechtsgrundlage ist extrem zweifelhaft! Ich bin mir sicher es wird Klagen geben! Selbstverständlich muss Kindesmissbrauch bekämpft werden - aber nicht so und als trojanisches Pferd, um anlasslos hunderte Millionen EU Bürger mit unzuverlässigen Algorithmen zu überwachen!

Die erste (illegale) Abstimmung zur Chatkontrolle ist gerade durchgegangen - Donnerstag fällt im Plenum die endgültige Entscheidung, ob zukünftig ALLES, was Sie im Netz schreiben, gescannt wird…

Ich habe heute versucht, die Chatkontrolle zu stoppen. Am Wochenende mussten Sibylle Berg und ich Parlamentspräsidentin Metsola schriftlich mitteilen, dass das Durchprügeln der Chatkontrolle im Eilverfahren leider gegen die Geschäftsordnung des EU-Parlaments verstößt. Während Metsola der interessierten Presse daraufhin (fälschlicherweise) mitteilte, dass das schon alles seine Richtigkeit habe, warten wir immer noch auf ihre Antwort. Deshalb wollte ich es ihr heute bei der Eröffnungssitzung in Straßburg noch einmal erklären. Und musste erstaunt feststellen, dass die Präsidentin doch Regeln kennt: Exakt nach 60 Sekunden hat sie mir das Mikrophon abgestellt. (regelkonform, wird aber selten gemacht) Dabei hätte ich noch einiges zu sagen gehabt: "Frau Präsidentin, Sie wachen nach Artikel 22 über dieses Regelwerk (mit der ausgedruckten Geschäftsordnung wedelnd) - erklären Sie den Eilantrag für unzulässig. Wir sind hier schließlich nicht auf Malta! Die aktuelle Fassung der Geschäftsordnung überreiche ich Ihnen gerne persönlich. In der MEP-Bar." Wie es nun weitergeht? Morgen wird über das Eilverfahren abgestimmt, obwohl diese Abstimmung gar nicht stattfinden dürfte. Wenn der Antrag erfolgreich ist, kommt die Chatkontrolle Donnerstagmittag zur Abstimmung ins Plenum. Um sie noch zu stoppen, müssten 361 Abgeordnete - eine qualifizierte Mehrheit - DAGEGEN stimmen. Die schlechte Nachricht: Donnerstag ist der letzte Tag vor der Sommerpause und viele MEPs dürften bereits auf dem Weg in den Urlaub sein. Ein Schelm, wer Böses denkt bei dieser Terminierung... Smiley! Wenn die Chatkontrolle durchgeht, dürfen die Plattformen (also die US-Tech-Bros) wieder & weiterhin fröhlich & ganz legal Ihre Nachrichten scannen.
