@Afinetheorem I think the problem here is the distinction between the letter of copyright law and the sentiment. IMO the sentiment behind copyright is that it takes a lot of effort to produce something new and we need to avoid disincentivising that by letting copiers reap the rewards.

NYT/OpenAI lawsuit completely misunderstands how LLMs work, and judges getting this wrong will do huge damage to AI. Basic point: LLMs DON'T "STORE" UNDERLYING TRAINING TEXT. It is impossible- the parameter size of GPT-3.5 or 4 is not enough to losslessly encode the training set.

Jason has long been my go-to source for breaking down Google and Meta legal developments, particularly when it comes to things like tracking, looks like he'll be my go-to for OpenAI and LLM copyright law developments too!
