לפי אותו היגיון, צריך להוציא את נציגי הקואליציה מהוועדה לבחירת שופטים, משום ששופטים יחששו לפסוק נגד הממשלה. במיוחד אמורים הדברים בהינתן שלקואליציה של שלושה מושבים בוועדה, ולכן גם יכולת להטיל וטו על קידום שופטים לבית המשפט העליון – בעוד ללשכת עורכי הדין יש שני מושבים בלבד, ולכן אין לה יכולת וטו כזו.   אגב, ניסיון השנים האחרונות מלמד שלוין וסטרוק אכן מנעו קידום של שופטים שנחשדו ב-"שמאלנות". אין שום תקדים לכך שנציגי לשכת עורכי הדין מנעו קידום של שופטים שפסקו נגדה.   וכמובן, שמשום מה נציגות הלשכה בוועדה לא הפריעה ל-@Meir_Rubin ושות' בימי כהונתו העליזה של אפי נוה. כך יצא.
