1. Initial distribution.
Early Bitcoins were aquired by mining, not by buying them from Satoshi. He didn't make a penny. Cardano was launced through an ICO, where people bought tokens from you, giving you money to help you develop Cardano, expecting to profit from your work.
A major question in your upcoming litigation is this: Did the Cardano team promise or imply that the ADA token might go up in value if your team makes it a success? Or did the investors expect this?
2. Decentralization.
While BTC has some big mining pools, each pool is composed of thousands of independent miners. If a pool's integrity is compromised, it takes only a few clicks for a miner to switch to a different pool.
Attempts of a 51% attack or censoring transactions would reduce the miner's profits, incentivicing them to switch pools. Thus Bitcoin cannot be attacked by attacking mining pools.
Cardano on the other hand is controlled and updated by you and your team. Funded by investors. Bitcoin is not controlled by Satoshi nor developers nor mining pools.
Even if the SEC thought BTC was a security, there would be no one to sue. To affect Bitcoin, they would have to sue each and every Bitcoin user (node runner) in the world. This is what decentralization means.
