@LBGHackney @deeharvey @SecretBusMgr Rehabilitation is nearly 3 times more likely to fail in a custodial setting The messaging needs to be better but I doubt that the death penalty would have stopped this happening I wish there was a middle ground but I can't find one

The clamour to lock up children is getting out of hand. I'm not defending what they did and any additional needs are not an excuse, but they are a contributing explanation. The impulse control and emotional regulation of these boys is likely that of 9/10 year olds...

@deeharvey @LBGHackney @SecretBusMgr I don't like the lack of criminality attached to the YRO, I think it sends the wrong message I think the judge was wrong to praise them But the best option for rehabilitation of children and long term safety is the YRO I think custodial guarantees reoffending down the line

@grahamchatterl2 @deeharvey Really?! One girl "almost made it seem as if what the boys did was not OK, but it was OK in the eyes of the law because they were still children". Does not seem the victim agrees with your assessment of being believed is enough Also, font forget they pleaded not guilty to rape

@SecretBusMgr @deeharvey ...and about not being satisfied that the punishment is strong enough or a strong enough deterrent But the deterrent system itself isn't working I think being believed is a more important factor than harsher punishments, but happy to be proved wrong

@grahamchatterl2 @deeharvey not about satisfaction, the justice system is built on there being a deterrent if you commit wrong doing By not putting these 'rapists' in prison you have indirectly enabled others to do the same, for they know there are no consequences + victims are less likely to come fwd

@SecretBusMgr @deeharvey So short term satisfaction is more important than long term safety? Because that's what we are talking about. If you put these children in prison you more than double the likelihood they will reoffend

@grahamchatterl2 @deeharvey Personally i feel using this case, one where a knife, filming, etc was used, to support YRO rather than custodial sentences, is a bad take. Some crimes just require a 'straight to jail, do not pass go'

@deeharvey @SecretBusMgr I have evidence that YROs reduce the risk of children reoffending If you have other evidence, especially some related to rape, please share I'm happy to change my mind, I'm not comfortable with the verdict but I can't ignore what the evidence says

The ‘line’ with regards to sentencing guidelines is a broad one. In this case, I believe the Judge could and should have imposed a Youth Custody sentence. The seriousness of the offences (multiple victims, repeated offending, group participation, filming, and using a knife to threaten) warranted custody. Furthermore, the sentence is being reviewed under the Unduly Lenient Sentence Scheme. Youth detention is not adult prison. I feel for the victims, their families, and worry that this provides absolutely no deterrent whatsoever.

Balance was totally lost and the impact on the victims was compounded by the focus on the age of the perpetrators rather than the impact on the child victims. It is a mind boggling sentence, and appears to be a million miles from justice. IMO, it will do little to deter others. Questions need to be asked of the judge and I am glad it’s being reviewed. It reinforces the need to be very careful about arbitrarily shifting the age of criminal responsibility in NI.

@grahamchatterl2 @deeharvey As much as rehabilitation is an important factor in the justice system, but if you don't consider rape to be a custodial sentence, then what is your bar? And if custodial sentence is not given for a very RARE guilty sentence what incentive is there for victims to come forward?

@SecretBusMgr @deeharvey If the evidence agreed with you then so would I Do you think this is a comfortable position to take? But YROs are considerably more successful at preventing reoffending, that is more important than feeling satisfied with the punishment

@grahamchatterl2 Strongly disagree here. The same view point can be used as a defence. For example, a group of men raping a woman, or looking back at world war atrocities, or many other heinous things where no one in the group said "wait a minute". At some stage being culpable is essential.

They also tend to not speak up in public to protect their relationship with the DfE. I’m sure they’ll be raising concerns. Something has to change - it may take a change of PM 1st
