L’Articolo 138 esiste proprio per evolvere, non per imbalsamare l'inefficienza. • Il trionfo del correntismo (39%): Si trema davanti al sorteggio del CSM come fosse un azzardo, preferendo tenere in vita il "sistema Palamara". Giuridicamente, abbiamo scelto il clientelismo certo delle correnti togata al posto di un meccanismo tecnico che avrebbe finalmente spezzato le catene tra magistratura e politica. Complimenti: abbiamo confermato il sistema dei "favori tra colleghi". • Il referendum usato come un televoto (31%): Votare No per "dare un segnale alla Meloni" è un errore tecnico imbarazzante. Si decideva la struttura della Giustizia per i prossimi cinquant'anni, non il gradimento di un governo che scade tra due. Abbiamo sacrificato i diritti dei cittadini sull'altare di un banale sondaggio d'opinione. Un suicidio logico. • L’addio al Giusto Processo: Bocciando la separazione delle carriere, abbiamo deciso che ci va bene un giudice che è "collega di scrivania" di chi ci accusa. L'Articolo 111 sulla terzietà? Una favola per bambini. Abbiamo votato per restare l'anomalia d'Europa, dove l'imparzialità è un optional. Quindi diciamo le cose come stanno: ha vinto la paura di capire e la pigrizia di studiare.
