Stand For Our Parents (SFOP) L'association des familles des détenus du TPIR / IRMCT Nous sommes les enfants, les familles et les proches des détenus jugés par le Tribunal pénal international(TPIR) pour le #Rwanda, aujourd’hui sous la juridiction du Mécanisme international résiduel pour les tribunaux pénaux. Un projet de transfert de ces détenus, actuellement incarcérés au #Bénin et au #Sénégal, vers le #Rwanda sera à l’étude au sein de l’Organisation des Nations Unies#ONU Nous exprimons notre profonde inquiétude et notre opposition formelle à ce projet. Nos proches purgent des peines prononcées par le Tribunal pénal international pour le Rwanda dans des établissements pénitentiaires placés sous supervision des Nations Unies. D’autres, acquittés ou ayant déjà purgé leur peine, sont maintenus dans une maison sécurisée au #Niger, sans statut juridique clair, dans l’attente d’une solution de relocalisation. Le projet de transfert vers le #Rwanda soulève de graves questions au regard de principes fondamentaux du droit international, notamment : • le principe Ne bis in idem • le principe de non-refoulement • le consentement libre et éclairé des détenus • les engagements pris par l’Organisation des Nations Unies envers les personnes placées sous sa juridiction. Notre démarche s’inscrit dans le respect du dialogue institutionnel et de l’État de droit. Nous appelons les autorités compétentes à examiner attentivement ces préoccupations et à privilégier des solutions alternatives respectueuses du droit international et de la dignité humaine. Stand For Our Parents (SFOP) The Association of Families of ICTR / IRMCT Detainees We are the children, the families and the relatives of detainees tried by the International Criminal Tribunal for #Rwanda(IRCTR), now under the jurisdiction of the International Residual Mechanism for Criminal Tribunals. A project to transfer these detainees, currently held in #Benin and #Senegal, to the Republic of #Rwanda is under consideration within the United Nations.#UN We express our deep concern and our formal opposition to this project. Our relatives are serving sentences handed down by the International Criminal Tribunal for #Rwanda in penitentiary facilities placed under United Nations supervision. Others, acquitted or having already served their sentence, are kept in a secured facility in #Niger, without clear legal status, awaiting a relocation solution. The transfer project to #Rwanda raises serious concerns under fundamental principles of international law, in particular: · the principle of Ne bis in idem · the principle of non-refoulement · free and informed consent of the detainees · the commitments undertaken by the United Nations toward persons placed under its jurisdiction. Our approach is rooted in respect for institutional dialogue and the rule of law. We call on the competent authorities to examine these concerns carefully and to favor alternative solutions that respect international law and human dignity.
