CAP-EXEMPT VIRGINIA TECH THINKS IT IS OKAY TO HIRE A FOREIGN H-1B EMPLOYEE FOR DINING SERVICES OVER AMERICANS. DINING SERVICES!! @chrisbrunet does an amazing job showcasing these roles, and they are the exact kind of position we have been trying to scream about the past few months. The legal basis is INA Section 214(g)(5)(A). The exemption attaches to the petitioning employer, not the department or job function. As long as Virginia Tech (a qualifying institution of higher education) is the direct petitioner, every H-1B they file skips the lottery and faces no annual cap. Dining services, IT, janitorial, admin, doesn't matter. No American was required to be considered. Universities are cap-exempt. They skip the H-1B lottery, face no annual limit, and have zero obligation to prove they looked for an American first. The only requirement is that the position itself still qualifies as a "specialty occupation" (requires a bachelor's degree). Data Analyst clears that bar.
