ChudTheBuilder shot a man who attacked him outside a courthouse in Clarksville & accidentally grazed himself in the process. Before it escalated, he asked the man if he was going to “chimp out” the man then walked up & sucker punched him. It is unclear if the man survived.

He’s fucked. This is a well-litigated legal question. The short answer is no — you generally cannot legally provoke someone and then claim self-defense, including in stand your ground states. The Provocation Doctrine Most states, including stand your ground states, have a provocation exception that bars a person from claiming self-defense if they were the initial aggressor or provoked the confrontation. This applies even where there’s no duty to retreat. Using racial slurs to deliberately antagonize someone with the intent to provoke a physical reaction would almost certainly qualify as unlawful provocation in the eyes of a court, stripping you of the self-defense claim. Why Verbal Provocation Can Disqualify You •Courts look at intent: if you deliberately provoked someone to create a pretext for violence, that’s not self-defense — it’s a setup. •Several states explicitly codify that a person who provokes the use of force cannot then claim self-defense. •Prosecutors and juries consider the totality of circumstances, including what led to the confrontation. Relevant Case Law & Examples •Florida’s Stand Your Ground law (§776.041) specifically states the defense is unavailable to someone who “initially provokes the use of force against himself or herself.” •Most other SYG states have similar carve-outs. •Racial slurs directed at someone to provoke a fight have been used by prosecutors to defeat self-defense claims. Potential Criminal Exposure Engaging in this behavior could result in charges including: •Murder or manslaughter (self-defense claim denied) •Hate crime enhancements in many jurisdictions •Civil liability to the victim’s family Bottom Line Stand your ground laws were designed to protect people from genuine, unexpected threats — not to create a legal loophole to provoke someone into a reaction and then use lethal force. Courts and prosecutors are well aware of this tactic, and it is very likely to result in criminal conviction rather than legal protection.
