Texas just did something most of the country still refuses to try: it made it legal to build housing again. For decades, we’ve treated housing scarcity like a mystery, blaming investors, interest rates, or “greedy developers.” But the reality is that we made it illegal, or nearly impossible, to build the kinds of homes people actually need. This is why Texas’s move toward by-right zoning is an important move for the nation's affordable housing crisis. If a project meets the rules, it gets built. No theater. No veto points. No months (or years) of delay. And almost immediately, developers responded, dozens of inquiries in just weeks, especially for the “missing middle” housing that has all but disappeared in most American cities.
