Hypocrisy Shai Malka was detained for four months after calling for road blockades (he merely calledfor them—he did not block anything) in protest of the implementation of the Disengagement Plan from Gaza, 2005. The panel of judges was headed by Chief Justice Aharon Barak, alongside four others, including Justice Ayala Procaccia. Malka argued that he was exercising his democratic right to non-violent civil disobedience. Take a look at Barak’s ruling, with Justice Procaccia’s concurrence: “The appellants' third argument is that the acts attributed to them constitute 'civil disobedience,' which they claim is protected in a democratic regime. I find no merit in this claim. In our case there is no need to address this argument, because there is no connection whatsoever between the defendants' alleged actions and civil disobedience. What they allegedly engaged in was not civil disobedience, but incitement. No theory of civil disobedience can justify ‘halting the state’ or paralyzing the mechanisms responsible for law enforcement.” In Israel today, roads are regularly blocked by the protest movement, yet no one is brought to trial. Now contrast that with the words of retired Justice Ayala Procaccia when the Knesset tried to reclaim even a fraction of the power the Supreme Court had seized for itself without any statutory basis: “We must consider civil disobedience, despite the costs its participants may have to bear—including breaking the law.” Aharon Barak and Ayala Procaccia are hypocrites. They are the “right kind of people,” while Shai Malka and his peers are “the others”. To these honorable Justices, human rights are merely a pretext for preserving their own power.
