An attorney writes to me about the mostly AI-written law review article he had accepted this spring, now forthcoming in the flagship law review of a Top 50 law school. A draft of the article is now up on SSRN. According to the attorney: " Last month I used Claude to assist in drafting a new article . . . . I drafted this article in about 15 hours. In 2022 I published an article of similar length that took around 150 hours." The attorney adds: "I used Claude the way I’d use a junior associate—as a first drafter, sounding board, and research assistant. Most of the article, including the entirety of the title, abstract, and intro, is mine from the keyboard up. And anything Claude contributed that made it to the final version is there because I reviewed it, agreed with it, and chose to sign my name to it. This is no different than how I’d review an associate’s draft and then take responsibility for the finished product." The attorney adds: "That first draft was by no means file ready, but it was better than what I would’ve received from the vast majority of BigLaw associates. I was blown away, and have since started my own appellate and litigation practice in an effort to replicate these productivity gains for client work." Your thoughts? I know the attorney's name, and the journal, and I have checked out the article, but I figured that, at least for now, I would hold that back.

It happened because policymakers pushed back on excessive litigation and rebalanced a system that had favored trial lawyer profits over affordability. Reform works. The data shows it.

@TomOliverson @TexasGOP Judges and Local Govt Officials need to have consequences for their actions. Ultra Vires needs to be codified with procedures. Scope of Work needs to be codified. I have a whole outline of things to address. The abuse has to end.

@TexLocGovAtty Yes! And if the influence is one day not tucked into lobby funding, it will be tucked into association fees, training costs, co-ops, risk mitigation, consulting, etc. It’s a big problem. Going to need govt level transparency on many of those orgs.

@LegeLawyer Man, the naturalization ceremony is one of the coolest events I have ever attended. I think it should be required for all US Citizens to attend so they can see how hard people want to be citizens and how proud they are to become an American!

Me immediately after my US citizenship interview at the USCIS office in Harlingen, Texas. Back in 2021, the Age of COVID. The whole process was quite anticlimactic - I never got a proper citizenship ceremony. But I dare to think my work attests to my patriotism.

In Teter, the Ninth voted to take a Second Amendment case en banc after Plaintiffs won. That vacated the panel ruling. But before the en banc panel could hear the case, Hawaii repealed the law at issue. The Ninth Circuit refused to restore the panel ruling, and Plaintiffs were denied attorney's fees because they were not technically prevailing parties. So cool!

What happens when an order becomes moot during the pendency of direct appeal? Often, if asked, courts will vacate any orders that the losing party loses an opportunity to appeal. Especially for published appellate decisions. Not for Temporary Protected Status, here, though!

I honestly think it’s just bureaucratic rot. They just know one way to do this. City Legal is conditioned to fight everything. City Management defers to City Legal for a while. They go thru the steps and then some on Council are like, why aren’t we settling this ? It doesn’t bother me as much when it’s kept in house bc we are paying City Legal regardless But paying up to $600,000 to Dan Richards firm AGAIN - literally now decades of this - is so insanely ridiculous They will milk the file as long as they can as any billable lawyer would. It’s especially infuriating bc the City is clearly in the wrong here. Settle and move on.

@LoewyLawFirm What do you think causes the city to litigate this? Hubris? An over zealous city attorney? Or is the plaintiff asking for way too much money? I agree, they will settle. A jury will eviscerate the city for this…

No, it is twitter. Hard to explain. The Fed Judge got it right. We can’t depend on State District Court Judges to do it. We have to find a way for District Court Judges to have accountability. I am waiting on an order to be signed from a trial that happened in Oct. I can’t get it.
