The legal status of the Strait of Hormuz has undergone a fundamental transformation: 🔹 The baseline of free and safe passage remained intact until Feb. 27. 🔹 Leading up to Feb. 28, however, the first significant alteration of the nature of transit occurred when the Americans transported weaponry through the Strait of Hormuz to their military bases in neighboring territories in preparation for an attack on Iran. Under int. maritime norms, passage loses its "innocent" or "transit" status once it involves the transport of weaponry intended for military operations, threats of force, or intelligence gathering against the security of the coastal state. 🔹 From February 28 onwards, the American and Israeli regimes effectively weaponized a geographic necessity intended for the "common good" of global commerce by utilizing the Strait of Hormuz to launch attacks against Iran, effectively transforming free and safe passage into an act of aggression. Under int. law, if a state utilizes a strait to launch an offensive, it effectively designates that area as a theater of war. Consequently, the coastal state acquires the legal right to suspend passage to preserve national security in self-defense. 🔹 This situation, moreover, invokes Article 62 of the Vienna Convention on the Law of Treaties, which codifies the doctrine of rebus sic stantibus (a fundamental change of circumstances), justifying a legal recalibration of the principles of free and safe passage with the legitimate security concerns of the coastal state. Simply "urging" adherence to the principles of free and safe navigation while totally disregarding the significant transformation caused by the aggressors is both unfair and legally unviable. Sadly, No one objected to the aggressors weaponizing the Strait of Hormuz—a global public good—throughout the preparation and execution of their attacks on Iran.

Guess who is opposing Dangote’s proposal to build a 1.2M barrels a day refinery in east Africa (Tanzania, Kenya and Congo) World Bank and IMF. : ))) Their argument? it would give monopoly to one company over energy. 1) All the while, French refineries are in almost every oil producing countries in Africa. 2) No African countries could get a loan to build a refinery larger than 400,000 barrels per day (one of the most profitable businesses ever). So the majority are small and struggle for profitability. 3) Nigeria oil had to be exported to Europe, refined and in many cases sold back to Nigeria and ECOWAS countries, under companies like shell and total. 4) it took until a billionaire financed the refinery in Nigeria himself to change part of that production and supply pipeline. And today, after the Hormuz blockade, EU countries are now buying oil from Dangote.
