This decision will subject countless non-citizens within the circuit's jurisdiction to punitive mandatory detention without an opportunity for a bond/release. This is the Avila case. The oral arguments on this issue are tomorrow on the 11th Circuit. We are waiting for the 9th Circuit to issue their decision which will also likely be 2-1. The question is which way. It’s not strong enough and it’s not new. In Florida, it applies to children 12 and under - death does not apply when pedophiles rape children ages 13–17.
