You’ve misunderstood what Judge Nicol meant regarding incident 1. Essentially, in short, he’s saying he ruled in NGN’s favour due to Depp’s and his team’s lack of credibility over the course of proceedings.

Both parties agreed on a “truth defence”.
That meant even if Heard gave them information, if it weren’t true, NGN would still lose.

@Ty45459 @moonbeam_blue No, it was based on what Heard told them. She didn’t have to ‘prove’ any of it as she was only a witness. Had she been part of the case she would have had to bring receipts. In the US trial she didn’t have any proof of abuse so she lost. 🤷🏼♂️

The UK has a thing called "freedom of press" and that's what the judge ruled in favour of. The Meghan Markle trial against the Daily Mail is similar to the Depp trial.

What they had to do was prove the substance of the allegation- that Depp did, in fact, abuse Heard. The defence was based on truth, not sourcing.

@moonbeam_blue He ‘lost’ the uk trial because the judge said ‘The Sun’ didn’t defame him because they only repeated what Heard told them. Depp was essentially told he’d sued the wrong entity. When he sued Heard in the US, he won as her allegations were proved to be lies. It’s that simple.✌️
