Our stand on regulation of school fees. The private minority schools claim they have a right to establish such schools, manage them & fix their own fee, under Article 29 & 30 of the Indian Constitution Other Non Minority Schools claim their right to profession under Article 19(1)(g) of the Indian Constitution and thus they can establish, manage such such schools & fix their own fee. Sure they have the right to establish & manage such schools but they don't have the right to mismanage them, this was the position held by the Supreme Court of India. Also they have a right to fix their own fee but they cannot profiteer or Commercialise education, is also clear as per numerous Orders of the Supreme Court. How can we establish if the school is commercialising or profiteering ? Reasonable regulations by the Government is permitted by the Supreme Court to prevent profiteering & commercialisation. While the schools are fixing their own fee, govt has to determine if schools are commercialising education & profiteering from such fee, by appointing a fee determination committee, for which some laws, Rules & Regulations have to be made by the Govt & these are being made with loopholes in collusion & connivance with private schools and yet challenged by the schools, they do not want to be regulated. When regulated, they get their way through by corruption. Those who have to enforce / implement the regulation are not doing so.
