Breaking: We’ve filed a lawsuit against the government of President Bola Tinubu over the failure to withdraw the patently unlawful mass phone-tapping rules known as ‘Lawful Interception of Communications Regulations, 2019.' The lawsuit followed allegations by the former Kaduna State Governor, Nasir El-Rufai that the National Security Adviser (NSA), Nuhu Ribadu’s phone conversation was intercepted. Mr. El-Rufai reportedly claimed, “The NSA’s call was tapped. They do that to our calls too, and we heard him saying they should arrest me.” In the suit number ECW/CCJ/APP/11/26 filed last Friday at the ECOWAS Community Court of Justice, Abuja, we are seeking a declaration that the failure of the government to withdraw the Interception of Communications Regulations is unlawful and a violation of Nigeria’s international human rights obligations. We are seeking a declaration that the failure of the government to withdraw the Interception of Communications Regulations constitutes an official endorsement of unlawful mass phone-tapping rules, as the Regulations are patently unlawful, and violate the rule of law, democratic principles, and the right to privacy. We are also seeking an order directing and compelling the Nigerian government to immediately withdraw the Interception of Communications Regulations, and to commence a legislative process to ensure that any interception regulations are in conformity with Nigeria’s international human rights obligations. The Regulations establish a sweeping mass phone-tapping regime that violates Nigerians’ constitutionally and internationally guaranteed human rights including to privacy and freedom of expression. Where powers affecting fundamental human rights are exercised in secrecy and concentrated in political authorities without independent supervision, the risks of arbitrariness are substantial. Surveillance measures that lack strict necessity, proportionality and independent judicial oversight can easily be weaponised against political opponents, journalists, civil society actors and election observers.

President Bola Tinubu has approved the constitution of the Nigerian side of the US-Nigeria Joint Working Group as part of steps to deepen collaboration in tackling security challenges in the country.   The composition of the Joint Working Group was part of the agreement reached during the recent trip to Washington, DC, by a high-level Nigerian delegation led by the National Security Adviser, Nuhu Ribadu.   Ribadu is to lead the Nigerian side of the Joint Working Group, supported by a multi-stakeholder team comprising senior officials from relevant government establishments.   Members of the Joint Working Group include the Minister of Foreign Affairs, Amb. Yusuf Maitama Tuggar, Minister of Defence, Mohammed Badaru Abubakar, Minister of Interior, Hon. Olubunmi Tunji-Ojo, Minister of Humanitarian Affairs, Dr Bernard M. Doro, Chief of Defence Staff, Gen. Olufemi Oluyede, Director-General of the National Intelligence Agency, Amb. Mohammed Mohammed and the Inspector General of the Nigeria Police Force, Mr Kayode Egbetokun.   Ms Idayat Hassan of the Office of the National Security Adviser (ONSA) and Mr Paul Alabi of the Embassy of Nigeria in the US will serve as the secretariat.   President Tinubu has urged members of the Joint Working Group to work assiduously with their US counterparts to ensure smooth operationalisation of all agreements across sectors.   Bayo Onanuga Special Adviser to the President (Information and Strategy) November 27, 2025
