Interesting to me that the 'hypersonic missile' incident, which USG officials have spoken about publicly, is not mentioned at all in any of the government's public arguments/evidence submitted to the court yesterday. The government's brief makes no mention at all of the incident, nor does the sworn testimony of Undersecretary Michael. As a reminder, this is the claim USG officials have made that Dario Amodei, in a conversation with DoW senior leadership, told them to 'call him' if they wanted to use Claude to defend against an imminent hypersonic missile attack. This is such a vivid story that you'd think it would be front and center in the government's legal arguments, yet it is nowhere to be found (in the publicly disclosed documents). It's possible that the claim is substantiated in the redacted documents, though given how public admin officials have been about it, it isn't totally clear why. It's also possible there are legitimate legal-strategic reasons for not mentioning specifics. So in other words, the lack of inclusion of these allegations in the brief is certainly suspicious, but not necessarily "proof" that the 'hypersonic missile' exchange is false. The brief does, however, substantiate the claim that Anthropic officials contacted a DoW vendor (presumably Palantir) during an unspecified military operation with concerns about the "potential use" of Claude in said operation. Presumably this is all referring to Venezuela, though it is not named (again, this could be for legitimate reasons). So there is evidence in favor that something really did happen there, though we know very little of substance about what was said.
