Potential isn't possession though. You said rights require HAVING the capacity...now it's MIGHT have it. That's a new rule. And it still doesn't save you: a baby's capacity is ahead of it, but end stage dementia and a permanent coma are irreversible. There's no potential coming back. By your own rule they lose their rights. So either grandma stopped being a person when the dementia took hold, or your rule just quietly became 'has it, will have it, or once had it'...which is just 'is human' in a disguise. The circular thing. Again.

@1776_ghost @MattWalshBlog Rights require the ability to form concepts or the potential to form concepts. Babies and children don’t have the same right fully formed adults do, that’s why they can’t consent. People with dementia have moments of clarity so yes they always have the potential.

perfect. thats locked in then. rights need forming concepts, recognizing rights in others, conceptualizing them. a newborn cant do a single one of those. neither can someone in late stage dementia or a permanent coma. so by YOUR rule none of them have rights. either you say that out loud, babies have no rights, or your criterion is broken and the only thing left is 'theyre human' which is the circular thing you been dodging since the start. which is it?

Citing the law about legal rights isn't an appeal to authority, it's the definition of the term. And you said 'animals don't have rights,' period. Now you mean natural rights? That's a different claim. Fine: if rights are inherent and not state granted, what grants them? Whatever your answer is, you now have to explain why a living, sentient animal doesn't qualify. You keep asserting it. Argue it.

Animals have legally enforceable protections in all 50 states. Every state has animal cruelty laws, many of them felonies. There's a federal Animal Welfare Act. You can go to prison for abusing your own dog and that's the key part: if animals had zero rights, cruelty laws would only protect the owner's property interest, but you can be prosecuted for abusing an animal you own. The law protects the animal itself. That's a right by any functional definition a legally enforceable protection against how others can treat you. Are they full legal "persons" with constitutional rights? No. But "no rights at all" and "not the same rights as humans" are very different claims, and he made the dumb one.

When I was younger the Ron Paul revolution was a big deal. I mean a really big deal. Tons of enthusiasm from the younger voters. "The future is libertarian! We will break the back of the central bankers! We will stop these endless wars!" Never went anywhere. I liked Paul too.
