The reason it isn't slavery, is because if it was ever given as a sentence, first off, it would not... But, if it was, you *STILL* have the freedom to tell the jailer "fuck you" and they won't whip you until you comply. You don't *have* to do the work. There is a pretty big difference.

When you break the law enough to go to jail/prison, you are sentenced to be held by the state/fed for a certain period of time.
