Not for nothing, but I’ve found that a lot of issues with clients getting upset when I tell them about the evidence can be avoided by not making whether they “did it” or not a part of the relationship at all. You really don’t have to do that for many cases.

@amyep9 @Triceratops235 @alittleleader I should have phrased more as a question, I suppose. IS there a disparity? And would you say the majority of your clients *would* fare better if they did go to trial? Is it totally case by case, or would most defenders generally prefer trial?

@Sandwich_Smith @Triceratops235 @alittleleader What’s the “disparity” you think exists here? Trial lawyers enjoy trials. The system would be better if people weren’t punished for exercising their right to trial. That doesn’t mean that having a trial in a given case will get that client a better outcome in the system we have.

Bruen used to be a dumb test that created predictable results. Now, after Rahimi, I don't think I could predict the outcome of any second amendment case, because I have no idea which old concerns will be analogous to modern laws. Why not just use normal tiers of scrutiny?
