Can someone explain to me how an H1B visa holder can leave their job to go back the their country of origin to apply for permanent residency and somehow keep the job that qualified them for the H1B? I’m so confused

Is this New at @USCIS policy memo legal? Possibly, going forward. Will this policy outlast this administration? No. Is it a stiff arm in the face from @USCISDirector Joe, who is possibly the laziest USCIS Director in history? Yes. Will this memo be challenged in court? Yes. Should you file for adjustment the status today? Talk to your lawyer. Will this memo apply to applications already filed? It should not be because this is a policy change that will certainly be challenged under the APA and should in no circumstance be retroactive. @PaulHerzog3 Not all employers have operations in other countries in order to have employees and pay them. The green card process takes years for these people. Years. You really think employers will accommodate that? Give me a fucking break lol

@arbetter Not sure what the issue is-I'm just pointing out that it's common for people to take leave from their jobs, sometimes for extended time periods. If your employer likes you they deal with it.
