They are not simply complicit, but active participants and should be held accountable for their actions. Crime of Aggression The UN special rapporteur on counterterrorism stated: "This is not lawful self-defence against an armed attack by Iran." Experts argue that "preventive disarmament, counterterrorism and regime change constitute the international crime of aggression." 7. UN Charter Article 2(2) (Good Faith in Negotiations) Launching strikes during active negotiations violates the principle of good faith under Article 2(2) of the UN Charter. Iranian policymakers had already accused the US of bad faith after earlier strikes disrupted previously scheduled talks. 8. Convention on the Prevention and Punishment of Crimes Against Internationally Protected Persons (New York Convention) Attacking heads of state is illegal under the New York Convention. The strikes targeted Iran crossing a threshold that distinguishes military operations from acts of aggression. 9. Geneva Convention (Duty to Rescue)After a US submarine sank the Iranian warship IRIS Dena, killing at least 84 people, US forces purportedly declined to help rescue sailors even though the Geneva Convention largely requires aid to the shipwrecked. 10. Laws of War on Civilian Protection Reports of an airstrike on a girls' school in the southern Iranian city of Minab killed at least 165 people. Experts noted "deeply alarming reports of attacks on schools and critical civilian infrastructure," raising serious concerns about violations of the laws of armed conflict protecting civilians.
