Many people are claiming a president must spend whatever Congress has appropriated. While this is generally true, it is not true in the absolute sense. A president can legitimately refuse to spend money if he or she believes and asserts that the specific spending is unconstitutional.
The president’s discretion here is connected to an aspect of the separation of powers that is often ignored or mistakenly denied. Each branch has an independent obligation to interpret and uphold the Constitution within its sphere of power and responsibility: making laws, executing laws, or deciding cases.

@AlanLevinovitz Dems have ceded this space to conspiracy theorists on the right.
There is big reform needed to address aggressively marketed ultraprocessed foods, basing scool lunches on them, regulatory capture, etc.
But Dems and allies seem to think there’s no role for govt on this. Crazy.

There's been a LOT about why RFK Jr is a terrible pick, but I want to focus on something that is very concerning to me, but no one seems to be mentioning.
He appeals to a widespread, common-sense idea that the problem with our food is that it has "lots of artificial ingredients". Get the artificial ingredients out — no chemical additives! no food dyes! no high fructose corn syrup! — and our health problems magically resolve.
This is 100% incorrect, and fundamentally misunderstands the problems with our food system.

@HeathMayo People didn’t change, the system did. Aggressive mktg of addictive ultra processed foods to kids + adults (+basing school lunches on them). Inadequate regs + reg capture by big ag/pharma. A health system focused on treatment over prevention + wellness.

Government isn’t going to make us eat healthier—we’re going to have to do that ourselves. Practically every major food brand has already developed organic and lower-calorie options in response to consumer demand. Plus, the “artificiality” of an ingredient has nothing to do with whether it is healthier for our bodies.
If we want to be healthier, we need to choose to eat smaller and healthier portions. It’s that simple. Neither the government nor the food manufacturers can make that choice for us. Only we can.
