MAJAMAA, I HAVE A VERY SENSITIVE MATTER HERE THAT NEEDS OUR SUPPORT🛑CONSUMER ALERT!🛑 " My name is Isaac Irungu. On the 18th of October 2016, I bought a 12.7Kgs gas cylinder from National Oil at my local shop in Buru Buru, Nairobi. On the morning of 19th October 2016, I lit the gas to boil water as I prepared my kids for school. Coming back, the water had not boiled and I resorted to using electric kettle. In 15mins my kids were done with breakfast and off they left for school. For those that have used National Oil gas, new cylinders emit very little gas. I came back to the kitchen to make my breakfast, and when I stroke the match, the whole kitchen went blue into flames. I got my treatment and while visitors streamed in, one of the visitors making some beverage noted that the gas had no smell. I notified @EPRA_KE whom in turn sent SGS to do an inspection. They did, and true to our fears, the LPG gas did not contain the "Ethyl Mercaptan" a chemical which is a foul smell that should notify someone of a leaking gas. National Oil senior officials visited me in November and suggested for compensation. But after the meeting, I called Safety Director of National Oil and he told me to direct my complaints to EPRA. When I did, I was requested by EPRA to send a fee note to National Oil through my lawyer. I did and we got a response from their insurance APA on the 31st of January 2017. They eventually requested for SGS report to process compensation which I have done over 15 letters( frame two is the latest) including countless visits to EPRA and by omission they are technically collapsing my compensation. The court has given as 14 days to get and file the SGS report and the deadline is 14th of May 2026. I have started an online petition, seeking help from Kenyans to help me pressurize @EPRA_KE to release the SGS report. The High Court has held that the in duplum rule applies to all lenders including microfinances. In Faulu Microfinance Bank Limited v Kilonzo, a borrower had taken a Kshs. 569,000 loan but defaulted, prompting the lender to claim over Kshs. 621,000. Despite the matter being undefended, the trial court applied the in duplum rule and reduced the recoverable amount to about Kshs. 145,000. On appeal, the lender argued that the rule only applies to banks, not microfinance institutions. The High Court rejected that argument, holding that the rule is a matter of public policy meant to protect borrowers from excessive interest, and therefore binds all lenders. Bottom line: no lender can hide behind technicalities to inflate debt endlessly.
