If this degree is legally and properly obtained, why approach the court against the investigation?
The judgement is also questionable. Very strange to declare the investigation unconstitutional.

Oscar Mabuyane, the Premier of the Eastern Cape, has successfully obtained a court ruling preventing the SIU from investigating his degree from the University of Fort Hare, which is suspected to have been obtained improperly. The court stated that investigating Oscar Mabuyane is unconstitutional and amounts to harassment.
