Time, place and manner. I didn’t see the man walking a child to a bus stop, did you? Look like he was walking with a child in an industrial area with the sun, barely on the horizon in the middle of the summertime. Generally, anyone walking in an industrial area outside of work hours is seen as suspicious because often times they don’t work there and so are trespassing. Not to mention they could be trying to steal copper, etc. Having a child with you I suspect just amplifies that suspicion even more. Either way, I would bet that the officers will be cleared of any wrong doing because I think a reasonable person could find that behavior not just suspicious but articulate specific crimes that could be afoot. Do I think the arresting officer escalated things quickly, yes, I do and for that reason, I think he might be in trouble. But the act of stopping them and asking questions I think was completely reasonable under the reasonable suspicion test.
