I wonder how many people understand that SCOTUS is going to uphold the tariffs because Trump ALREADY has the power to tariff. It was codified in 1962 & again in 1974 by Congress. Trade Expansion Act of 1962 Purpose: Passed during President John F. Kennedy’s administration, this act aimed to liberalize global trade and strengthen U.S. economic relations, particularly through negotiations under the General Agreement on Tariffs and Trade (GATT). Key Provisions: Section 201: Authorized the president to negotiate tariff reductions of up to 50% with other countries, giving the executive branch broad power to shape trade policy. Section 232: Allowed the president to impose tariffs or other restrictions on imports if the Secretary of Commerce determined that such imports threatened national security. Example: This provision was later used by several administrations, including President Trump’s tariffs on steel and aluminum in 2018. Effect on Presidential Power: The 1962 act delegated significant tariff authority from Congress to the president. Traditionally, Congress held the constitutional power to regulate commerce and set tariffs, but this law allowed the executive to act more swiftly and flexibly in negotiating and adjusting tariffs to protect U.S. interests. Trade Act of 1974 Purpose: Enacted amid economic challenges like the oil crisis and trade imbalances, this act modernized trade policy, promoted free trade negotiations, and created mechanisms to respond to unfair foreign trade practices. Section 301: Empowered the president (via the U.S. Trade Representative) to retaliate against countries engaging in unfair trade practices, such as discriminatory tariffs or intellectual property theft. Fast-Track Authority (now called Trade Promotion Authority): Allowed the president to negotiate trade agreements that Congress could approve or reject, but not amend—speeding up implementation. Effect on Presidential Power: The 1974 act substantially expanded executive discretion in trade policy. It gave the president direct tools to enforce trade rules and negotiate deals without lengthy congressional intervention, effectively centralizing control over both tariff enforcement and trade retaliation. Maybe the real question would be to ask why no one in Congress tried reversing Trump's efforts when he frist implemented tariffs in 2018? Or why "Joe Biden" never reversed any of the 2018 Trump tariffs, when he "had the power" to do so? Or why the D-led Congress didn't reverse the 1962 & 1974 trade acts when they held the power in 2021-2022?
