The case law of L K Advani would have been applied for the purpose of defining the position of Kuladip Senger as an MLA . Judges should have also considered the intent of section 21 of IPC . ---- Author Rajesh Ranjan, Advocate Supreme Court of India Mobile-9868478485 Email:-rajeshrnjn7@gmail.com THE EUPHEMISM OR THE MISERY OF THE POCSO ACT On 29.12.2025 ,The Hon’ble Supreme Court led by the Bench of Chief Justice of India has stayed the operation of the impugned Judgment dated 23.12.2025 passed by the Hon’ble Division Bench of the Delhi High Court who was pleased to suspend the Sentence of the Convinct Kuldeep Singh Sengar and further ordered to release him on bail. The order passed by the Division Bench of the Delhi High Court stormed with the multifarious controversy . The Public sentiment of the people across the race and religion shakened completely and it started taking shape of the public outrage against the said controversial judgment . The recent public outrage reminisced the past when the rapist and murderer of Priyadarshini Mattoo was acquitted by the Trial Court due to lack of evidence and miscarriage of justice was caused to the victim and her family and people across the sphere came on the street with the candle march and procession. The comparison of the present case( Kuldeep Singh Senger vs CBI )1 with the Priyadarshini Mattoo (State Through CBI Vs Santosh Kumar Singh )2 are not out of context. In both the cases the investigation were carried out by the CBI when the family of the victim doubted upon the local Police. In both the cases the family of the victim made a yen for the Justice . In both the cases, the act of the investigating agencies were extremely criticised for the biaseness and partial investigation to save the accused and finally to cause the mis- carriage of justice. The latest controversy arose with suspension of the sentence of the Convict Kuldeep Singh Sengar and Grant of bail by the Division Bench of the Delhi High Court citing the rights of the Convict contained Under Article 21 of the Constitution ignoring the fact that the right to life under the same provisions are also available to the Victim who is living a life continuously under the threat by the Convict for years . It cannot be overlooked that the Victim was merely about 16 years of age when she was brutally raped by the Convict and threatened to remain silent on the occurrence otherwise her family would not be spared. The perception of the threat by the Convict was further corroborated with the fact that shortly after the complaint regarding the incident was lodged, the uncle of the Victim as well as father of the Victim were assaulted by the brother of the Convict . The father was firstly implicated in a false Arms Act case and beaten to death in the Judicial Custody . The dominance of the Convict Kuldeep Singh Sengar upon the Law Enforcing agency has already shown its tone and tenor. Then the question arise that requirement of the protection of rights under Article 21 of the Constitution of India is more to the Victim crying for justice or the power drunken Convict Kuldeep Singh Sengar ? There can be a valid comparison of the present case with Priyadarshini Mattoo where the father of the Convict Santosh Kumar Singh was IG of Police and the various complaints of stalking and molestation were lodged by the Victim but the culprit used to be let off by the Police using father’s influence. /1 @ANI @PTI_News @ians_india #UnnaoCase
