I came across this on LinkedIn and can't believe such things are happening. This is ILLEGAL. Under Zambia’s Employment Code Act No. 3 of 2019, it is unlawful for an employer to categorically exclude Zambian nationals from applying for a job without justification. Section 14(1) of the Act is VERY clear. “Subject to the other provisions of this Act relating to the employment of an expatriate, an employer shall, in filling an employment vacancy, employ a citizen except where a citizen does not posses the skills required for that job or a citizen does not apply for that job." As if that is not enough, Section 5 is equally VERY clear. (2) (a) An employer shall not, in any employment policy or practice discriminate, directly or indirectly, against an employee or a prospective employee - on grounds of colour, NATIONALITY, tribe or place of origin, language, race, social origin, religion, belief, conscience political or other opinion, sex, gender, pregnancy, marital status, ethnicity, family responsibility, disability, status, health, culture or economic grounds; Explicitly excluding Zambians violates the law and is in fact subject to penalties under Zambian labor law. And honestly, even if this law didn't exist, it should occur that this is not right.
