The SC bench of Justices Vikram Nath & Sandeep Mehta have delivered an important & Salutary judgement today asking the CBI to conduct a detailed Preliminary Investigation into the thousands of crores of Contracts given by the Arunachal govt to companies of the CM Pema Khandu & his family. The govt of Arunachal has been directed to provide all info & docs relating to these contracts to the CBI. The CBI to submit its report to the court in 16 weeks

Archives | Surya Kant faces allegations of grave misconduct. In 2012, a real-estate agent accused the judge of having participated in illegal property dealings involving undervaluation and cash transactions worth several crores. In 2017, a prisoner in Punjab filed a complaint listing eight cases heard by Kant, and alleged that the judge had accepted bribes to grant bail in these. Though these complaints have been sitting with the collegium for over six years, Kant remained a judge at the Punjab and Haryana High Court till October 2018, when he was appointed the chief justice of Himachal Pradesh High Court. The collegium recommended his name for the post even though the questions arising from the complaint had not been resolved, and according to a former Supreme Court judge, it will do so again—this time, for elevation to the apex court. #UmarKhalidBailPlea: Can you fathom the absurdity of this? The Supreme Court of India says "continued detention has not crossed constitutional impermissibility to override the statutory embargo as against them" in the case of Umar Khalid and Sharjeel Imam. In other words, Justice Aravind Kumar means that although a constitutional court can grant bail if the period of incarceration is long, unjustified, or disproportionate, in the case of Khalid and other, the time in jail is NOT YET long enough, the delay is NOT YET shocking or unconstitutional, and that Article 21 right to life and liberty has NOT BEEN VIOLATED yet! The constitutional right to liberty has NOT reached a level STRONG ENOUGH to defeat the draconian UAPA bail prohibition! FIVE YEARS in jail without possibility of trial starting is not good enough for Hon'ble Lordships Justice Aravind Kumar and Prasanna Varale!

The Supreme Court should BACK OFF from pushing this country any further into the abyss of state-managed speech. If so-called “self-regulatory” mechanisms for online intermediaries are inadequate—as Chief Justice Kant now repeatedly laments—then the same criticism applies equally, if not more, to television news channels, right? Should we then permit “an autonomous body, free from influence” to sit on the heads of TV channels too? And who will constitute this body? Angels? Also, if the VERY INSTITUTION most empowered and protected by the Constitution—the Supreme Court of India—is unable to remain free from influence, political pressure, ideological capture, and selective action, then what “independent” statutory institution is the Court imagining into existence? THERE IS NONE! And there can be none in the current political-institutional climate. The only constitutional answer to bad speech has ALWAYS been MORE speech—not state-authorised sanitisation! The Court should resist this temptation to hand the government even more censorial architecture to gag free expression under the guise of “regulation” or “reasonable restrictions”. The assurance that the Court will ensure these new powers are not misused is fiction—or worse, an outright LIE. The Supreme Court cannot enforce such a promise on a daily basis, and the history of free-speech jurisprudence shows that it does not possess the institutional will to intervene when the State inevitably weaponises these frameworks. Also, if the courtroom of the Chief Justice of India sanctifies any such provision through a judicial order, what happens when someone challenges the law/provision on the grounds of unconstitutionality in the future? What the hell is Chief Justice Kant thinking!? I wrote in greater depth about this judicial fantasy in my column: “Can courts protect free speech while designing its boundaries?” (frontline.thehindu.com/columns/mahara…) Meanwhile, the Court displays remarkable lethargy toward matters that genuinely demand judicial urgency. For instance, challenges to blatantly unconstitutional laws like Maharashtra’s so-called “Urban Naxal Act”, and contempt petitions arising from the Bulldozer judgment. These are the cases that go to the heart of rule of law and protection against executive overreach. At a time when democratic space is shrinking, the Supreme Court should be reclaiming its constitutional role, NOT becoming a designer of censorship!

CJI Surya Kant: See the issue is given and the shown starts. But by the time you decide not to watch it starts. The warning can be for a few seconds.. then perhaps ask for your aadhaar card etc. So that your age can be verified and then the program starts. Of course these are illustrative suggestions...a combination of different experts .. someone from judiciary and media can be there also.. let something come up on pilot basis and if it clogs free speech and expression it can be looked at then .We need to build a responsible society and once that happens most of the problems will be solved.#SupremeCourt
