After yesterday's news of the EU proposing sanctions against #FIDE president Arkady Dvorkovich, his administration panic-rushed the Council meeting which was supposed to be held on 17 June for ...tonight(!) via ...whatsapp(!!). Dvorkovich is now literally forced to tolerate some kind of "suspension" of the Russian Chess Federation (RCF) while, at the same time, the FIDE Council still bypasses its own statutes in numerous ways, trying to keep RCF benefits by attempting to create non-existing "loopholes". In particular: I.) Article 13.6 of the FIDE Charter clearly states that "the suspended Member Federation forfeits its rights under Art. 10 and its officials and national teams may not participate in any FIDE congress, competition, event or activity." With tonight's resolution, the FIDE administration is blatantly bypassing its own Charter by deciding that "teams composed of players who are citizens of the Russian Federation may be eligible to participate in FIDE team competitions under a neutral flag subject to the further FIDE Council decisions." As if the FIDE Council is above the FIDE Charter and the CAS. Unbelievable! II.) The FIDE Council decided that a final court ruling such as the one of the CAS is subject to a ...vote of the FIDE General Assembly(!!). Again bypassing FIDE's Charter which clearly states, in article 35.1, that the Court of Arbitration for Sport (CAS) resolves disputes in a FINAL and binding manner. Therefore, the CAS decision of 11 March is subject to no further "approval" by any General Assembly and there is no room for legal wrangling as the FIDE administration attempts. Overall, the current FIDE regime is clearly not willing to quit bad habits. It is also obvious that, despite the clear conflicts of interest, FIDE continues to engage Russian legal advice for issues that require independent advisors (only). Good luck to an administration which treats conflicts of interest as unknown words and resolves such problems via ...whatsapp. On the positive side, huge congratulations once more to the @UAchessfed🇺🇦, @PHChess and @AndriyBar ! You proved how this sloppy FIDE administration can be defeated in ALL levels.
