The government says most travellers will now return to the previous 30-day limit instead. The company was registered in January 2019 with 2 million baht capital. Investigators found the Italian defendant was the real investor and manager while Thai nationals held shares on paper to bypass Thailand’s Foreign Business Act. Authorities uncovered repeated shareholder changes, concealed foreign ownership, foreign funding, and Thai nominees with no real investment or management authority. Financial records and business operations showed actual control remained with the foreign owner. Charges included illegal foreign business operations, using Thai nominees, and allowing foreigners to work outside authorized rights. The Italian defendant received a 1 year sentence and 100,000 baht fine, reduced after confession, suspended for 2 years, plus an additional 20,000 baht fine. Thai defendants received suspended jail terms and 50,000 baht fines after confessing. The company was also fined. The court ordered the business shut down, Thai shareholders to surrender all shares, and all support for the operation to cease. Violations trigger daily 10,000 baht fines. Police called it a “standard formula” commonly used in Thailand’s restaurant, tourism, villa, and service sectors where foreigners secretly control businesses through Thai nominee shareholders holding the required 51% ownership on paper only.
