Because once an artist dies, there's a 70 year grace period "Artists Resale Right" after their death before their work enters the public domain. So technically, it's possible to exploit the image and make money from it (like what print on demand websites do, or like he did). The only thing he wasn't allowed to do was claim "he created it" (for copyright reasons), but no one's going to sue him for that, so he doesn't risk anything serious tbh
